These Terms and Conditions ("Terms") are between you and Churmell Mitchell LLC and its brands, including Emotions You Know™, A Father's Voice Matters, A Mother's Voice Matters, Refill™, BRB Again, Churmell Mitchell, and Churmell Mitchell Productions (together, the "Company," "we," "our," or "us"). They govern your use of our websites and services. They apply when you access our websites, book or take part in a conversation, submit a form, attend a program or event, or buy a product or subscription. By doing any of these, you agree to these Terms. If you do not agree, please do not use the sites or services. If you accept on behalf of an organization, you confirm you have authority to bind that organization, and "you" includes that organization.
You agree to use our sites and services lawfully. You will not interfere with their operation, attempt unauthorized access, or use them to infringe the rights of others.
Our websites, online accounts, checkout, booking, and paid services are intended for adults 18 years and older, and any account, purchase, or booking must be made and managed by an adult. Our products, games, programs, and content are designed for use by children, students, families, classrooms, groups, and communities, with an adult (such as a parent, guardian, teacher, counselor, or group leader) buying and supervising that use. Children may use our products and take part in our programs under the supervision and responsibility of an adult. The adult is responsible for deciding what is appropriate for the children in their care. Anyone may purchase our products as a gift or for a child, family, classroom, or group, and the person who completes the purchase confirms they are at least 18 and is buying as the responsible adult.
All content, marks, names, logos, designs, frameworks, methodologies, curricula, games, written and recorded material, and the structure and look of our sites are the sole and exclusive property of the Company Churmell Mitchell LLC and its brands, including Emotions You Know™, A Father's Voice Matters, A Mother's Voice Matters, Refill™, BRB Again, Churmell Mitchell, and Churmell Mitchell Productions (together, the "Company," "we," "our," or "us") or its licensors, and are protected by intellectual property laws in the United States and internationally. All rights are reserved worldwide. No person or organization, anywhere in the world and regardless of size or resources, whether they work with us, work near us, or simply encounter our materials, may copy, reproduce, adapt, distribute, reverse-engineer, create derivative works from, or commercially use any of our materials without our prior written permission.
This section governs any conversation, consultation, discovery call, strategy session, meeting, program discussion, or form submission ("Conversation") you book or take part in with us.
"Confidential Information" means any information, data, materials, and knowledge, in any form, that we own or share relating to our brands, products, programs, services, operations, strategies, finances, customers, suppliers, designs, methods, frameworks, curricula, trade secrets, and intellectual property, whether or not marked confidential, including anything derived from what we share.
You will use Confidential Information only to evaluate or carry out a possible working relationship with us, keep it in strict confidence using at least a reasonable degree of care, and not disclose, reproduce, or distribute it to any third party without our prior written consent. You will not reverse-engineer, decompile, or disassemble any Confidential Information unless the law expressly allows it.
You may share Confidential Information only with your directors, officers, employees, agents, advisors, and consultants who need it for that purpose and who are bound by confidentiality obligations at least as protective as these Terms. You are responsible for their breaches.
Confidential Information does not include information that is or becomes public through no fault of yours, was already known to you without a duty of confidentiality, is independently developed by you without using our Confidential Information, or is rightfully received from a third party who is free to share it.
If you are required by law or court order to disclose Confidential Information, you may do so only to the extent required, after prompt written notice to us where allowed, and you will disclose only the portion legally required.
All concepts, frameworks, methodologies, curricula, models, systems, names, marks, content, documents, decks, recordings, and materials that we own or present during a Conversation remain our sole and exclusive property, together with all related intellectual property, whether or not protected by trademark or copyright. No patent, copyright, trademark, or other right is licensed or transferred to you beyond a limited right to use the information to evaluate a possible engagement with us. Any ideas, recommendations, plans, or materials we create or present in connection with a Conversation are ours. This does not claim ownership of your own pre-existing business, brand, or materials that you bring to the Conversation.
You will not, directly or indirectly, copy, adapt, reproduce, reverse-engineer, or create a derivative or competing version of our concepts, frameworks, curricula, programs, or materials; use our Confidential Information or proprietary methods to build, launch, or operate a similar product, program, or service, whether on your own or with or for a third party such as a school, district, private or homeschool program, nonprofit, agency, organization, or company; or circumvent us by going around us to replicate our offering, recreate it internally, or engage our sources, partners, or contacts to reproduce what we shared. These restrictions apply during and after a Conversation, apply worldwide, and apply to any person or organization that accesses, receives, or encounters our materials, including contractors, vendors, freelancers, agencies, platforms, and companies of any size. They do not restrict your lawful right to operate your own separate business that does not use our Confidential Information or proprietary material.
For five (5) years after a Conversation, you will not directly or indirectly solicit, recruit, or encourage any employee or contractor of the Company who was involved with the Confidential Information to leave us. General advertising not aimed at our team, and any person who contacts you on their own, are not a breach of this section.
When you submit content through a form, inquiry, or Conversation, you confirm you have the right to share it, and you grant us a license to use it as needed to respond to you and operate our services. Any feedback, idea, suggestion, concept, proposal, or material you send us, whether we asked for it or not, is treated as non-confidential as to the Company Churmell Mitchell LLC and its brands, including Emotions You Know™, A Father's Voice Matters, A Mother's Voice Matters, Refill™, BRB Again, Churmell Mitchell, and Churmell Mitchell Productions (together, the "Company," "we," "our," or "us") , and you grant the Company Churmell Mitchell LLC and its brands, including Emotions You Know™, A Father's Voice Matters, A Mother's Voice Matters, Refill™, BRB Again, Churmell Mitchell, and Churmell Mitchell Productions (together, the "Company," "we," "our," or "us") a perpetual, irrevocable, worldwide, royalty-free right to use, adapt, combine, and build on it for any purpose, without obligation, attribution, or payment to you. Please do not send us anything you consider confidential or that you do not want us to use. This does not reduce the confidentiality obligations you owe to us under these Terms or any separate agreement.
Where you consent, for example by checking the consent box on a form or by taking part in a recorded Conversation, session, event, or program, you grant the Company Churmell Mitchell LLC and its brands, including Emotions You Know™, A Father's Voice Matters, A Mother's Voice Matters, Refill™, BRB Again, Churmell Mitchell, and Churmell Mitchell Productions (together, the "Company," "we," "our," or "us") the right to record, photograph, and capture audio, video, and screenshots, and to use those recordings, photos, video, quotes, statements, and testimonials for business, marketing, educational, and promotional purposes across any media now known or later developed, without further approval or compensation, unless we agree otherwise in writing. You confirm that anyone you bring has also consented, and if you bring a minor, you confirm you are that minor's parent or legal guardian and you consent on the minor's behalf. If you do not consent to recording, tell us in writing before the Conversation or session begins.
On our written request, or when your access ends, you will promptly return or destroy all Confidential Information, including copies, notes, and summaries, and confirm in writing that you have done so. You may keep one copy only to determine your continuing obligations or as required by law, and that copy stays subject to these Terms.
Some offerings, including Refill™, Churmell Mitchell LLC and its brands, including Emotions You Know™, A Father's Voice Matters, A Mother's Voice Matters, Refill™, BRB Again, Churmell Mitchell, and Churmell Mitchell Productions (together, the "Company," "we," "our," or "us") memberships, are sold as one-time or recurring paid subscriptions.
When you buy a subscription, you authorize us and our payment processor to charge your payment method the stated price and any applicable taxes for the plan you select.
Paid subscriptions described as recurring renew automatically at the end of each billing period, for example monthly or for the stated term, at the then-current price, and your payment method is charged on each renewal until you cancel. The length and price of your billing period are shown at checkout before you buy.
You may cancel a recurring subscription at any time before the next renewal date through your account or by contacting us at the email below. Cancellation stops future renewals. Access continues until the end of the period you already paid for.
Unless stated otherwise at the point of sale or required by law, payments are non-refundable, and canceling stops future charges rather than refunding the current period. Any specific refund or trial terms shown at checkout for a plan control for that plan.
We may change subscription prices. We will post the change and apply it on your next billing period after notice.
Deposits and down payments are non-refundable unless we state otherwise in writing. We may cancel, pause, reschedule, or decline any order, booking, program, event, or service, for any reason, and our responsibility for doing so is limited to refunding amounts you paid for the cancelled item that we have not already committed or spent. If you cancel, you remain responsible for costs we have already incurred or committed on your behalf, and any cancellation fee or notice period stated at the time of purchase or in a separate agreement applies.
Our content Churmell Mitchell LLC and its brands, including Emotions You Know™, A Father's Voice Matters, A Mother's Voice Matters, Refill™, BRB Again, Churmell Mitchell, and Churmell Mitchell Productions (together, the "Company," "we," "our," or "us"), conversations, programs, games, and tools are provided for educational, communication, and strategic purposes. They are not therapy, medical care, psychological treatment, legal advice, or financial advice, and they do not create a clinical or professional relationship. Our brands and tools are communication and emotional-clarity resources meant to support, and not replace, care from a licensed professional. The Company Churmell Mitchell LLC and its brands, including Emotions You Know™, A Father's Voice Matters, A Mother's Voice Matters, Refill™, BRB Again, Churmell Mitchell, and Churmell Mitchell Productions (together, the "Company," "we," "our," or "us") is a faith-based organization. Our content, conversations, programs, teaching, and materials are created from a Christian worldview and biblical principles and reflect the sincerely held religious beliefs, values, and mission of the Company and its founder. Taking part is voluntary, and you are free to accept or set aside any spiritual or faith-based content. By using our sites, products, programs, or services, you understand and agree that we share our own faith-based perspective as part of our mission and identity, that our content is not spiritual, pastoral, clinical, legal, or financial counsel, and that we are not responsible for whether our content aligns with your personal beliefs, values, or convictions. We teach, operate, and make decisions consistent with our religious beliefs and mission, to the fullest extent permitted by law.

You are responsible for your own decisions, actions, and wellbeing, and for those of anyone in your care. To the fullest extent permitted by law, the Company is not responsible or liable for any emotional, psychological, mental-health, relational, spiritual, behavioral, financial, or personal outcome, reaction, decision, or consequence that you or anyone else experiences in connection with our content, advice, teaching, products, programs, or services. To the fullest extent permitted by law, the Company Churmell Mitchell LLC and its brands, including Emotions You Know™, A Father's Voice Matters, A Mother's Voice Matters, Refill™, BRB Again, Churmell Mitchell, and Churmell Mitchell Productions (together, the "Company," "we," "our," or "us") is not responsible or liable for the personal, off-duty, or unauthorized acts of any of its personnel that fall outside the scope of the work they perform for the Company.
The sites and services are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the sites will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, the Company Churmell Mitchell LLC and its brands, including Emotions You Know™, A Father's Voice Matters, A Mother's Voice Matters, Refill™, BRB Again, Churmell Mitchell, and Churmell Mitchell Productions (together, the "Company," "we," "our," or "us") and its owners, members, managers, officers, team, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the sites or services. Our total liability for any claim is limited to the amount you paid us, if any, for the specific product or service giving rise to the claim.
You agree to indemnify and hold harmless the Company Churmell Mitchell LLC and its brands, including Emotions You Know™, A Father's Voice Matters, A Mother's Voice Matters, Refill™, BRB Again, Churmell Mitchell, and Churmell Mitchell Productions (together, the "Company," "we," "our," or "us") and its owners, members, managers, officers, team, and partners from claims, damages, and expenses, including reasonable attorneys' fees, arising out of your use of the sites or services, your submissions, or your breach of these Terms.
You agree that a breach or threatened breach of the confidentiality, ownership, non-use, non-circumvention, or non-solicitation sections may cause us harm that money alone cannot fully repair. In addition to any other remedy, we may seek injunctive relief, including temporary restraining orders and preliminary or permanent injunctions, without posting a bond, and we may recover reasonable attorneys' fees and costs incurred in enforcing these Terms. These remedies are cumulative.
We use third-party tools such as scheduling, CRM, payment, and analytics platforms. Your use of those tools may also be subject to their own terms. We are not responsible for third-party services.
A Conversation is exploratory. It does not create a partnership, joint venture, employment, or agency relationship, or any binding commitment to work together. Any engagement will be set out in a separate written agreement signed by both parties.
These Terms are governed by the laws of the State of Alabama, the state in which Churmell Mitchell LLC is formed, without regard to conflict-of-law rules. You agree that any dispute will be brought in the state or federal courts located in Lee County, Alabama, or, at the Company's election, in another venue where the Company is formed, is registered, or maintains a principal place of business, and you consent to personal jurisdiction and venue in any such court. Where the law allows, the Company Churmell Mitchell LLC and its brands, including Emotions You Know™, A Father's Voice Matters, A Mother's Voice Matters, Refill™, BRB Again, Churmell Mitchell, and Churmell Mitchell Productions (together, the "Company," "we," "our," or "us") may also elect to resolve a dispute by binding arbitration. Nothing here prevents the Company Churmell Mitchell LLC and its brands, including Emotions You Know™, A Father's Voice Matters, A Mother's Voice Matters, Refill™, BRB Again, Churmell Mitchell, and Churmell Mitchell Productions (together, the "Company," "we," "our," or "us") from seeking injunctive relief in any court of competent jurisdiction.
The confidentiality, non-disclosure, ownership, non-use, non-replication, non-circumvention, non-solicitation, media consent, and limitation-of-liability sections survive after your use ends. The confidentiality and non-use sections survive for ten (10) years after the relevant Conversation, and the ownership and consent sections survive for as long as the law allows.
We may update these Terms at any time. Changes are posted on this page with a revised effective date. Continued use after changes are posted indicates acceptance.
